GLOBAL DISCLAIMER
All applications developed, published, or otherwise provided by Josh Fenton (the “Service Provider”) are offered strictly as-is, without any warranty of any kind. None of the Service Provider’s applications should be deemed to be suitable for any particular purpose. Users download, install, and use the applications entirely at their own risk.
To the fullest extent permitted by law, the Service Provider disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, reliability, or non-infringement.
By using any application developed or provided by the Service Provider, you agree that the maximum liability of the Service Provider, under any legal theory and in any circumstance, shall not exceed the purchase price paid for the application (if any).
This limitation of liability applies universally to all applications developed, released, maintained, or distributed by the Service Provider, without exception.
TERMS OF USE
Ownership and Rights
Unauthorized copying, modification, translation, reverse engineering, or creation of derivative works of the application is prohibited.
All trademarks, copyrights, database rights, and other intellectual property rights related to the applications remain the property of the Service Provider.
Modifications and Updates
The Service Provider reserves the right to modify applications or charge for their services at any time and for any reason.
You agree to always accept updates to the application when offered.
The Service Provider does not guarantee that applications will always be updated to remain compatible with future versions of your operating system.
Termination of Use
The Service Provider may cease providing applications at any time without notice.
Upon termination:
Your rights and licenses under these terms will end.
You must cease using the application and, if necessary, delete it from your device.
User Responsibilities
You are responsible for keeping your device charged and secure.
Jailbreaking or rooting your device (removing software restrictions imposed by the operating system) may compromise security and may result in the application not functioning.
Some features require an active internet connection. The Service Provider cannot be held responsible if the application does not function due to a lack of connectivity or exhausted data allowance.
You accept responsibility for any charges incurred by your mobile network provider, including roaming charges.
PRIVACY POLICY
Information Collection
The Service Provider does not actively collect, store, or share personal information from users of the applications.
The only information that may be received is that which you voluntarily provide when contacting the Service Provider for support or troubleshooting purposes (for example, by emailing support).
Use of Information
Any information you voluntarily provide is used solely to assist with resolving your support inquiry.
Sharing of Information
Information you provide is never shared with third parties.
It is not sold, rented, or otherwise disclosed for marketing or advertising purposes.
Data Retention
Any user-provided support information is retained only as long as reasonably necessary to provide assistance, and then it is securely discarded.
Children’s Privacy
The Service Provider does not knowingly collect personal information from children. If you believe your child has provided such information, please contact the Service Provider to have it promptly deleted.
USE OF COPYRIGHTED IMAGES
Most images displayed within the applications are not embedded in the app itself, but are instead shown via direct links to third-party sources such as Wikipedia. These images are subject to the copyright and licensing terms set by their respective rightsholders.
In some cases, certain images may be embedded directly into the applications. If any such embedded images are not in the public domain, appropriate attribution to the rightsholder will be provided within the Settings section of the application. Users are encouraged to review these attributions to understand the licensing and usage conditions for such images.
LIMITATION OF LIABILITY
While the Service Provider strives to ensure applications are useful and reliable, reliance on application features or third-party data sources is at your own risk. The Service Provider accepts no liability for any direct, indirect, incidental, or consequential losses arising from the use of applications.
As stated above, the maximum liability shall not exceed the purchase price paid for the application, if any.
CHANGES TO THESE TERMS AND PRIVACY POLICY
The Service Provider may update these Terms of Use & Privacy Policy from time to time. You are encouraged to review this page periodically for any changes. Updates will be effective immediately upon posting.
